PACIFIC HOISTS PTY LTD ACN 000 631 032 (“Pacific Hoists”)

Eagle Pro products sold by Pacific Hoists with the exception of those outlined below, are guaranteed against any fault arising from manufacturing defects caused by faulty workmanship and/or materials for the life of the product, being the period up until the product no longer functions as intended due to normal wear.

Any additional products sold with your Eagle Pro product are not covered by this warranty. Electrical components of Eagle Pro products, if any, are covered for a period of one year.

This Eagle Pro product warranty does not apply to any damage, loss or faults caused by normal wear and tear, abuse, heat, alteration, incorrect installation or use for a purpose other than that for which it was intended, or use in a manner inconsistent with the instructions or use other than in accordance with good practice.

Should any product fail under this warranty in the specified period, the product must be returned at the claimants cost, to Pacific Hoists with proof of purchase. The product will be examined and tested and if found to be defective by Pacific Hoists in its sole judgement, will be repaired or replaced and returned to the claimant at the claimant’s cost.

To the extent permissible by law:

1. All conditions or warranties not expressly set out in this document, whether implied by law or otherwise, are excluded;
2. Pacific Hoists’ liability for breach of the warranty contained in this document and any condition or warranty not able to be excluded by law is limited to the full extent permissible by Section 68A of the Trade Practices Act;
3. Under no circumstances will Pacific Hoists be liable for any consequential loss, loss of profits,labour costs, damage to property or any other loss other than the remedy specifically referred to in this document.

This warranty may only be varied with the written approval of the directors of Pacific Hoists.
